General Terms and Conditions
Last updated: February 2026
1. Scope
These General Terms and Conditions (GTC) apply to all orders and purchases through the online shop timedeals.ch, operated by TimeDeals Pavelka, Berglistrasse 28A, 8180 Bülach, Switzerland (hereinafter 'Seller').
By placing an order, the buyer accepts these GTC. Deviating conditions of the buyer are not recognized unless the seller expressly agrees in writing.
2. Conclusion of Contract
The display of products in the online shop does not constitute a legally binding offer, but an invitation to place an order (invitatio ad offerendum).
The purchase contract is concluded when the seller confirms the order by email or dispatches the goods.
3. Prices and Payment
All prices are in Swiss Francs (CHF) including any applicable VAT. Shipping costs are shown separately and are to be borne by the buyer unless otherwise stated.
Accepted payment methods: credit card, TWINT, PayPal, and other payment methods offered at checkout.
Payment is due in full at the time of the order. An order is only binding upon successful payment. Without payment, no purchase contract is concluded and no goods are reserved or shipped.
Auctions: For auction purchases, payment is due within 96 hours after the auction ends. The seller sends the highest bidder a payment link by email. If payment is not received within this period, the auction is cancelled and the item is re-listed.
4. Shipping and Delivery
Shipping from Bülach, Switzerland via registered mail (with signature) through Swiss Post. Delivery time is typically 1–3 business days within Switzerland and 3–10 business days internationally.
| Region | 1st Watch | Each additional |
|---|---|---|
| Switzerland | CHF 6.80 | + CHF 5.00 |
| EU / Europe | CHF 12.50 | + CHF 5.00 |
| International (USA, Asia, etc.) | CHF 16.50 | + CHF 5.00 |
All prices in CHF. Shipped via registered mail (delivery confirmation with signature).
4.2 Transfer of Risk: For buyers residing in Switzerland, risk passes to the buyer upon handover to the carrier. For consumers residing in the EU, mandatory consumer protection rules remain unaffected; risk transfer takes place according to the applicable statutory provisions.
4.3 International Orders: Any customs duties, import taxes, and local charges in the destination country are the responsibility of the buyer. The seller has no influence on these costs and cannot estimate them in advance.
4.4 Returns: The costs and risk of return shipping are borne by the buyer in all cases — regardless of the reason for return (withdrawal, goodwill return, or complaint) and regardless of the buyer's country of residence. This includes postage, customs duties, import taxes, and insurance. Unpaid or unfranked shipments will not be accepted. Insured shipping is recommended — the buyer is liable for loss during return transit.
5. Warranty for Vintage & Used Goods
The seller exclusively trades in used, vintage, and collector's items. These goods are partly several decades old (up to 65+ years).
5.1 Scope of Warranty: The warranty is limited exclusively to hidden defects that already existed at the time of delivery and were not mentioned in the item description. For buyers residing in Switzerland, the warranty is excluded to the fullest extent permitted by law under OR Art. 199. For buyers residing in the EU, the warranty period is 1 year from delivery (Art. 7(1) EU Consumer Sales Directive for used goods).
5.2 Not a Defect — what the warranty does NOT cover:
- Age-related wear: patina, scratches, fading lume, discoloration — normal for vintage items and not a defect
- Damage caused by the buyer: impacts, drops, improper handling, contact with water (unless described as water-resistant)
- Complaints about properties already visible in the item description or photos
- Normal wear and battery consumption
5.3 Batteries and Consumables: Batteries are consumable items. The note 'new battery' or 'battery replaced' means the battery was newly installed at the time of shipping. Battery life depends on watch type, movement age, gasket condition, and environmental factors, and can vary significantly (3 months to 3 years). Battery depletion after purchase is not a defect and does not constitute a warranty claim. The same applies to all other consumable parts (gaskets, crowns, straps).
5.4 Condition Description as Contract Basis: Each item is offered with detailed photos and a condition description. This description and photos form the binding basis of the purchase contract. What is described and/or depicted does not constitute a claimable defect.
5.5 Functionality: Unless expressly stated otherwise, no guarantees are given regarding timekeeping accuracy, water resistance, or other functionalities. Vintage watches may require servicing due to their age. If an item is described as 'functional' or 'running', this refers exclusively to its condition at the time of shipping.
5.6 Burden of Proof: For used goods, the buyer bears the burden of proving that a defect already existed at the time of delivery. A complaint must be made in writing to info@timedeals.ch immediately upon discovery of the defect, but no later than 7 days after receipt of the goods.
5.7 Intentional Deception: The warranty limitations do not apply in cases of intentional deception or fraudulent concealment of defects by the seller.
5.8 Authenticity Guarantee: The seller guarantees the authenticity of all offered items. If an item proves to be a counterfeit, the buyer has an unlimited right to a full refund of the purchase price.
6. Right of Withdrawal and Returns
For Buyers in Switzerland
Under Swiss law, there is no statutory right of withdrawal for online purchases. A purchase is binding. As a goodwill gesture, the seller grants a voluntary return option within 14 days of receipt.
For Buyers in the EU
Consumers residing in the EU have a statutory right of withdrawal of 14 days from receipt of the goods, without giving reasons, in accordance with the EU Consumer Rights Directive (2011/83/EU). To exercise your right of withdrawal, an informal notification to info@timedeals.ch is sufficient.
For Buyers outside CH/EU (USA, UK, etc.)
For buyers outside Switzerland and the EU, there is no statutory right of withdrawal. The purchase is binding. A voluntary return is only possible after prior agreement by email. All return shipping costs (postage, customs, import tax) are borne by the buyer. Unfranked shipments will be refused.
Conditions for All Returns:
- The item must be returned in unchanged, undamaged original condition
- All return shipping costs (postage, customs, taxes) are borne by the buyer — in all cases
- Unfranked or unpaid shipments will not be accepted
- Insured shipping is recommended — the buyer is liable for loss during return transit
- Refund within 14 days after receipt and inspection of the goods
- Auction items are excluded from the right of return
A return must be registered in advance by email to info@timedeals.ch.
7. Auctions
Every bid placed is binding and cannot be withdrawn. The highest bidder at the end of the auction is obligated to purchase.
Payment is due within 96 hours after the auction ends. The seller sends the highest bidder a payment link by email. If payment is not received within this period, the auction is cancelled and the item is offered to the second-highest bidder or re-listed.
The same warranty exclusions apply to auction items as per Section 5.
8. Data Protection
The collection and processing of personal data is carried out in accordance with our Privacy Policy.
9. International Buyers (Asia, USA, UK, rest of world)
For buyers outside Switzerland and the EU, these GTC and Swiss law apply exclusively. There is no statutory right of withdrawal. A voluntary return is only possible after prior written agreement by email.
All costs related to returns — including international postage, customs duties, import taxes, and insurance — are borne exclusively by the buyer. Unfranked or unpaid shipments will be refused and not returned.
The buyer is responsible for compliance with import regulations in their country. The seller is not liable for shipments seized or held by customs.
10. Applicable Law and Jurisdiction
Swiss law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For EU consumers, mandatory consumer protection provisions of the country of residence remain unaffected.
Place of jurisdiction is Bülach, Canton of Zurich, Switzerland.
11. Severability Clause
If individual provisions of these GTC are or become invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid one that comes closest to the economic purpose of the invalid provision.
